1 - GENERAL

EVODRIVER is a driving school that sells automotive training, organizes seminars and creates events. EVODRIVER is not bound to provide any service that is not included in an agreement signed between its client and EVODRIVER.
The services provided by EVODRIVER are subject to the following general terms and conditions which apply to all sales operations concluded by EVODRIVER and to which the buyer agrees without restriction or reservation as soon as they send EVODRIVER a booking form or an estimate. The total or partial nullity of any clause of the General Conditions does not entail the nullity of their other provisions.
Any EVODRIVER customer acknowledges having the capacity to contract under the conditions described in the sales conditions presented below, i.e. having reached the legal age of majority and not being under guardianship or curatorship.
These conditions are an integral part of the sales contract.

2 - INFORMATION ABOUT THE SERVICES

2-1 General

Through its various commercial and communication channels, EVODRIVER sells its services with the necessary characteristics to comply with Article L 111-1 of the Consumer Code, which provides the potential buyer with the opportunity to know, before placing a final order, the essential characteristics of the products they wish to purchase.
In addition, the customer can always call 06 08 06 67 22 to obtain further information about the services presented, if they deem it necessary.
EVODRIVER describes its services with the greatest accuracy. However, if an error of description appears on a service, EVODRIVER's liability cannot be incurred on this basis. We strive to illustrate our offers with photos or illustrations giving you a realistic overview of the services offered. We point out, however, that some photos and illustrations we use are simply illustrative of our services. They only commit EVODRIVER insofar as they indicate the category or degree of standing of these services and do not call into question the validity of an order placed or a sale made.

2-2 Restrictions and qualifications

The choice and purchase of a service are the sole responsibility of the buyer. The impossibility of using the product purchased, for any reason whatsoever, can in no case give rise to compensation or cancellation of the purchase from EVODRIVER.
Please note that our centers sometimes refuse to provide the service to a pregnant woman when they consider that, due to the term of pregnancy, there is a risk of premature labor during the service. The same applies to anyone showing signs of poor physical condition.
No one is required to hold a driving license: EVODRIVER operates on closed circuits and, by its status, provides advanced driving training.

2-3 Additional services

As service durations may extend over one or more days, our centers may handle the booking of meals and accommodation. These services are generally an integral part of our services and their price. EVODRIVER may, for various reasons, change the accommodation and catering mentioned without this constituting a modification of an essential element of the service. As far as possible, the customer will be informed in advance and EVODRIVER will provide them with a service in the same category as that initially proposed. No compensation may be claimed by the customer.
Although all complementary activities to our activities that we may offer have been confirmed by our providers and we have therefore offered them in good faith, it may happen, for reasons beyond our control and specific to these providers, that these activities are suspended or cancelled without our having been informed. EVODRIVER cannot be held responsible in the event that such incidents occur. Furthermore, some proposed activities may present risks; EVODRIVER cannot be held liable in the event of an incident or accident attributable to a lack of vigilance on your part.

3 - PRICES / PAYMENT / DELIVERY

All sales prices are expressed in Euros. They must be checked upon receipt of the booking form or estimate by the customer.
Only the services explicitly mentioned in the booking forms and estimates are part of the package.
For any registration more than 10 days before the service, it becomes effective upon return of the completed booking form or the estimate accepted by the customer, accompanied by a deposit equal to at least 50% of the total amount. Payment is made by bank transfer to the account of EVODRIVER LLC, the details of which will be sent to you upon receipt of the booking form or the accepted estimate by email or mail.
For any registration within 10 days before the service, the total amount of the service will be required. The balance is payable no later than the day of the service under the conditions applicable to the deposit; failing payment, we would be entitled to terminate the contract under the cancellation conditions indicated in this document. EVODRIVER accepts payment by check or cash on site in our centers.
We reserve the right to modify our prices upwards or downwards to take into account significant variations between the day of registration and that of the service performance (fuel cost, for example). For any order, EVODRIVER reserves the right to ask you to send us by mail a Kbis extract (company registration), a power bill or any other proof of address.
The delivery of booking forms and estimates can be made at our centers, by email or by post at no additional cost to the customer. In cases where their sending entails additional costs, these, communicated at the time of booking, remain the responsibility of the customer. EVODRIVER cannot be held responsible for any failure in delivery.

4 - CANCELLATION / MODIFICATION / TRANSFER

4-1 Cancellation, modification, transfer at the customer’s initiative

Failure by the customer to meet the payment deadline will be considered by EVODRIVER as a cancellation requested by the customer.
In the event of cancellation, deposits are never refundable.
Any service canceled, interrupted or shortened by the customer will not entitle them to any refund. If the customer wishes to postpone their service, this will only be possible if they inform one of our centers at least 10 days in advance and they will have to comply with the availability of our centers’ schedules.
Any request for modification or transfer (the customer may transfer their service to a third party, provided they indicate precisely the name and contact details of the transferee and justify that they meet the same conditions as the customer to carry out the service) must be reported to EVODRIVER at least 10 days before the service.

4-2 Cancellation at the initiative of our centers

If our centers are forced to cancel the service (except in cases of force majeure), the customer will be informed no later than 10 days before the service and a postponement of the service complying with the availability of the schedule will be proposed at that time.
The descriptions may mention a minimum number of customers below which EVODRIVER reserves the possibility of not providing the service. In this case, EVODRIVER informs the customer by any means, at the latest 10 days before the service. The customer is immediately reimbursed for all sums paid. The customer cannot claim damages. In some cases, the service may be maintained despite the insufficient number of participants for an additional price which will be requested from the customer.

4-3 Modification at the initiative of our centers

Due to the possible unforeseen events in driving schools, participants are warned that what is described to them constitutes the rule but that they may observe and experience exceptions. If essential elements must be modified before the service, the customer will be notified no later than 10 days before the service, which will offer the customer either the possibility of canceling their service without charge or the possibility of subscribing to a new service offered by EVODRIVER.
If, during the service, one of our centers could not provide a predominant part of the services provided for in the contract representing a non-negligible share, EVODRIVER must either offer a replacement service at no extra charge or, if EVODRIVER cannot offer a replacement service or if this service is refused by the customer for a valid reason, reimburse the customer for their travel expenses and any other expenses incurred.

5 - FORCE MAJEURE

Force majeure refers to any external event to the parties that is both unforeseeable and insurmountable, which prevents either the customer or one of our centers from performing all or part of the obligations provided for in the contract.
This will notably be the case in terms of technical incidents or accidents caused by third parties or significant weather events.
It is expressly agreed that force majeure suspends, for the parties, the performance of their reciprocal obligations. At the same time, each party bears all the costs incumbent upon it and resulting from the case of force majeure: consequently, the customer shall bear alone their travel expenses and any other costs incurred.

6 - CIVIL LIABILITY

EVODRIVER has taken out, with AXELLIANCE BUSINESS SERVICES, 92 cours Vitton - 69006 LYON, a contract covering the consequences of its professional civil liability, notably covering bodily injury, material and immaterial damage combined up to €450,000 per insurance year.
If you are the victim of breakage, loss or theft of personal item(s), our centers disclaim all responsibility; all consequences resulting from breakage, loss or theft of personal item(s) are at your expense.

7 - USAGE RIGHTS / OWNERSHIP

Photos, commercial brochures and other paper or computer media, tangible or intangible, belonging to EVODRIVER are provided with a personal right of use, which prohibits the customer from making any copy, transfer or public distribution other than those provided for by the legislation on ownership.
Any customer holding any medium whatsoever bearing EVODRIVER’s image is subject to these regulations and undertakes, by reading these general sales conditions, to respect the rights and legislation in force regarding ownership of these media.
The use of said media for commercial purposes may be granted if it is established beforehand, after discussion and regulation by both parties, by EVODRIVER, that these commercial actions will indeed be in its favor.

8 - JURISDICTION

The general sales conditions presented above are governed by French law. Any dispute concerning these general sales conditions will be submitted to the sole Commercial Court of Grenoble.

9 - DATA PROTECTION

In application of Law 78-17 known as Informatique et Libertés (Data Protection Act), customers are informed that their order is subject to computerized nominative processing. The right of access and rectification guaranteed by law is exercised with EVODRIVER at its headquarters.
